HOW TO ENTER
These rules govern the CAMC Vasectomy Procedure Promotion (the "Promotion") being conducted by Charleston Area Medical Center ("CAMC") beginning on January 15, 2020, at 8:00 a.m. Eastern Time ("ET") and ending on February 15, 2020, 5:00 p.m. ET ("Promotion Period").
To participate in the Promotion, you must log onto www.camc.org/SnipDunk between January 15, 2020, at 8:00 am ET and February 15, 2020, at 5:00 pm ET ("Entry Period"), follow the links and instructions to enter the Promotion and submit your first and last name, complete address, telephone number, date of birth and a valid email address in the online entry form.
Only one entry per person and one entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider, or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address.
ALL entries submitted become the sole property of CAMC and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by CAMC. CAMC’s computer is the official time keeping device for the Promotion. CAMC is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, and other technological problems. Entries must be received by CAMC by 5:00 pm ET on February 15, 2020, to be eligible.
The Promotion is open to all persons who are 18 years of age or older and who reside in West Virginia, Ohio, Kentucky, or Virginia. This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited.
Employees of CAMC are eligible to enter or win, including CAMC subsidiaries and affiliated entities, members of their immediate families (spouse, parent, sibling, or child), and those living in the same household of each (whether related or not).
Employees of CAMC Urology are not eligible to enter or win, including members of their immediate families (spouse, parent, sibling, or child) and those living in the same household of each (whether related or not).
Federal health care plan beneficiaries are not eligible to enter or win.
The winner must provide valid government-issued photo identification and provide their complete address, date of birth, and phone number to claim a prize.
Participants are required to provide truthful information and CAMC will reject and delete any entry that it discovers to be false or fraudulent. CAMC will disqualify any entry from individuals who do not meet the eligibility requirements. CAMC will also delete any entry knowingly received from persons under the age of 18.
One (1) grand prize will be awarded in this Promotion that consists of one vasectomy procedure surgery ("Procedure") performed by Dr. Samuel Deem in the office of CAMC Urology, 3100 MacCorkle Avenue SE, Suite 602, Charleston, WV, 25304 ("Procedure Provider"). Should Dr. Deem be unavailable to perform the Procedure for any reason, the contest winner will be notified and another physician with CAMC Urology will perform the Procedure.
If winner is a Medicaid beneficiary, Medicaid will be billed and a copayment of up to $10 may apply.
Final eligibility for the Procedure will be determined by the Procedure Provider.
Approximate Retail Value ("AVR") of the Procedure is $800. The prize includes a preoperative assessment and consultation, the Procedure, and any aftercare including a semen analysis in 2 to 3 months.
The winner will receive prescriptions for an antibiotic and pain relievers as medically indicated. Costs related to postoperative prescriptions are the responsibility of the winner and are not included in the prize.
The Procedure is non-transferable. The winner will be solely responsible to Procedure Provider and/or hospital for any additional costs, post-procedure care and any other expenses not offered specifically herein associated with the Procedure, if any, which shall be determined solely between the Procedure Provider and prize winner.
The Procedure must take place by April 6, 2020.
The winner will be subject to approval for the Procedure described above by the Procedure Provider. The Procedure Provider has the right to refuse to perform the Procedure at his sole discretion, based on
any medical reasons. In the event that the Procedure Provider chooses not to perform the procedure on the winner, neither CAMC nor the Procedure Provider will be obligated to provide a substitute prize.
There is no substitution, transfer, or cash equivalent for prize. The prize is expressly limited to the Procedure listed above. Other restrictions may apply.
WINNER SELECTION AND NOTIFICATION
Decisions of CAMC management with respect to the Promotion are final.
At approximately 9:00 am ET on February 17, 2020, CAMC will randomly select one (1) winner from all online entries received during the Entry Period.
CAMC will notify the winner by telephone. Prize will be awarded upon confirmation of eligibility.
Winner need not be present to win.
CAMC reserves the right to not choose a winner if no eligible entries are submitted.
The winner must execute and return any required W-9 form within three (3) days of notification by CAMC or prize will be forfeited and alternate winner may be selected from the remaining entries. If a potential prize winner cannot be contacted, fails to return a required W-9 form within the required time period, or if a prize notification is returned as undeliverable, potential winner forfeits prize. Prior to the Procedure, informed consent will be obtained.
Payments of all federal, state and local taxes are solely the responsibility of the winner.The winner may be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by CAMC in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.
All persons that submit an entry give permission for CAMC to contact them for advertising or other purposes.
The winner of the Promotion is not obligated to release his name or identity (he may choose only to be known to the contest administrators and medical staff performing the Procedure). If winner consents to release his name to be used in marketing or publicity materials related to the Promotion, he will need to sign a publicity release confirming such consent.
If for any reason this Promotion cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of CAMC that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, CAMC reserves the right to cancel, terminate, or modify the Promotion. If the Promotion is terminated before the original end date, CAMC will select the winner by random drawing from among all eligible non-suspect entries received as of the time of termination time or otherwise modify the procedure for selecting winner. Additionally, CAMC reserves the right to cancel, terminate, or modify the Promotion at any time, including after winner has been selected, if CAMC’s legal counsel, in its sole discretion, determines that any portion of the Promotion is contrary to law.
CAMC, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of CAMC’s website. Failure to comply with the rules of the Promotion may result in a participant’s disqualification and/or forfeiture of any prize. If CAMC makes a good faith determination that a participant has cheated or committed fraudulent activity in connection with the Promotion, CAMC reserves the right to disqualify that participant from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law.
CAMC reserves the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of CAMC, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, CAMC reserves the right, but not the obligation, to cancel or modify the Promotion and shall not be required to award a substitute prize.
CAMC is not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of the prize.
